Who we are
Dwelln is made by Acadia AI LLC, Maine, United States ("we", "us"). Contact us at support@dwelln.app. These terms are the agreement between you and us for the Dwelln app and website.
Accepting these terms
By creating an account or using Dwelln, you agree to these terms. If you don't agree, please don't use the app. If you're using Dwelln on behalf of a household or organisation, you're confirming you have permission to accept these terms for them.
Your account
- You need to be at least 13 years old to use Dwelln.
- Sign in with Apple, with Google, with a link we email you, or with an email address and password. Keep that account and password secure; anyone who controls them can reach your Dwelln data.
- Give us accurate information, and tell us if you think someone else has got into your account.
- You're responsible for what happens under your account.
- You can delete your account at any time in the app under Settings → Delete account. The Privacy Policy explains what that removes.
Your home data stays yours
The dwellings, equipment, tasks and history you put into Dwelln belong to you. You give us permission to store, process and display that content only so we can run the service for you: sync it across your devices, generate your reminders, and show it to people you deliberately share a dwelling with. We don't sell it and we don't use it for advertising. See the Privacy Policy for how we handle it.
Sharing a dwelling
When you share a dwelling, the people you invite can see and change that dwelling's information, including its tasks, photos and history. Only share with people you trust, and remove access when you no longer want them to have it. If someone shares a dwelling with you, treat their information with the same care.
Using Dwelln properly
We give you a personal, non-transferable licence to use the app. Please don't:
- break the law with it, or use it to store someone else's information without their permission;
- try to break into, overload, or reverse-engineer the service;
- resell or rent access to Dwelln, or use it to build a competing product;
- upload malicious code or content you don't have the rights to.
Plans, subscriptions and billing
Dwelln has a free plan and two auto-renewable monthly subscriptions:
- Free: one dwelling you own, its full maintenance schedule, reminders, Google Calendar sync and an Apple Calendar subscription, at no cost.
- Group (US$0.99 per month, per person): share the one dwelling you own with the people you live with. Everyone who joins a Group dwelling needs their own Group or Pro plan. A Group plan covers one shared dwelling; a second one needs Pro.
- Pro (US$4.99 per month): as many dwellings as you like under one account, and you can share any of them. People you invite to a Pro subscriber's dwelling don't pay.
Prices are shown in the app before you buy, in your local currency and including any applicable tax, and the price shown there is the one that applies. Prices outside the United States may differ.
- Subscriptions are bought in the Dwelln iOS app and processed by Apple, not by us. Payment is charged to your Apple ID account when you confirm the purchase. We never receive your card details.
- Subscriptions renew automatically each month unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID account is charged for the renewal within the 24 hours before the current period ends, at the same price unless we've told you of a change.
- Manage or cancel a subscription at any time in your Apple ID account settings (Settings → your name → Subscriptions), or from Dwelln's settings under "Manage subscription". Cancelling stops the next renewal; you keep your plan until the end of the period you've paid for.
- Deleting the app or your Dwelln account doesn't cancel a subscription. Cancel it in your Apple ID settings.
- Refunds for App Store purchases are handled by Apple under Apple's policies; you can request one at reportaproblem.apple.com.
- Changing plan (for example from Group to Pro) is handled by Apple and takes effect as Apple describes when you confirm it.
- We may change prices or what a plan includes. If we do, we'll tell you before the change affects a renewal, and Apple will ask for your consent where its rules require it. You can cancel if you'd rather not continue.
If a subscription ends
Your data isn't deleted when a paid plan lapses. You keep access to your account and your existing information; features that need a paid plan, such as extra dwellings and sharing, stop being available until you subscribe again.
Reminders are a nudge, not a guarantee
Never rely on Dwelln alone for anything affecting safety, health, insurance or legal compliance, including smoke and carbon-monoxide alarms, heating and gas appliances, electrical work, structural issues, or anything a qualified professional should check. Suggested maintenance intervals are general guidance, not advice about your particular home. You remain responsible for maintaining your property and for following the manufacturer's instructions and local rules.
The App Store
If you downloaded Dwelln from Apple's App Store, these terms also include the following:
- These terms are between you and Acadia AI LLC only, not Apple. We, not Apple, are responsible for Dwelln and its content.
- Your licence to use the app is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions, including use by other accounts associated with you through Family Sharing or volume purchasing where those rules allow it.
- We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide any maintenance or support for Dwelln.
- If the app fails to meet any warranty that applies by law, you can tell Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app, and any other claims, losses or costs from a failure to meet a warranty are our responsibility, subject to these terms.
- We, not Apple, are responsible for any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer-protection, privacy or similar claims.
- If anyone claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending and settling that claim.
- You confirm that you're not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you're not on any U.S. Government list of prohibited or restricted parties.
- You must also follow any third-party terms that apply when you use the app, such as your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
Questions, complaints or claims about the app go to us: Acadia AI LLC, 735 Main St, Bangor, ME 04401, United States, support@dwelln.app.
Changes to the service
We're actively building Dwelln, so features may be added, changed or removed. If we ever discontinue the service, we'll give you reasonable notice and a way to get your data out.
Ending things
You can stop using Dwelln and delete your account at any time in the app under Settings → Delete account, or email us and we'll do it. Deleting your account doesn't cancel an App Store subscription; cancel that in your Apple ID settings. We may suspend or close an account that breaks these terms, is being used to harm someone, or where we're required to by law. If we close your account without cause, we'll refund any unused portion of a paid period.
No warranty
Dwelln is provided "as is". We work hard to make it reliable, but we don't promise it will be uninterrupted, error-free, or that reminders will always arrive on time. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limits on liability
To the extent the law allows, we're not liable for indirect or consequential losses, lost data, or damage to your property arising from maintenance that wasn't done or wasn't done in time. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if you're on the free plan. Some places don't allow these limits, in which case they apply to you only as far as the law permits, and nothing here limits liability for fraud, death or personal injury caused by our negligence.
Governing law
These terms are governed by the laws of the State of Maine, United States, without regard to its conflict-of-law rules. Disputes go to the state or federal courts located in Maine, unless the consumer-protection law where you live gives you the right to bring a claim somewhere else.
Changes to these terms
If we change these terms we'll update this page and the date at the top. If a change is significant, we'll give you notice in the app or by email before it takes effect. Continuing to use Dwelln after that means you accept the updated terms.
